Event Terms & Conditions

Please read these terms and conditions ("Terms") carefully, as they contain essential information regarding your attendance and participation in the BiggerBash event (the “Event”) in Las Vegas, Nevada, scheduled for September 6 – 8, 2024.

These Terms apply to anyone registered and holding a pass (the “Pass”) for the Event. This includes individuals who personally purchased the Pass and individuals holding a Pass purchased by someone else (hereinafter referred to as “Attendee” or “you”). The purchase of a Pass constitutes a legally binding contract between you and BC Productions Inc. (“BCPI” or the “Organizers”), outlining your rights and responsibilities. If you purchase a Pass on behalf of another, these Terms also bind that individual. You are responsible for informing them of these Terms. Please review these Terms thoroughly before purchasing Passes or attending the Event. If you disagree with any of the Terms, the Organizers cannot permit your participation in the Event.

The Organizers, their venues, agents, managers, volunteers, staff, affiliates, suppliers, and contractors are granted rights, exemptions, defenses, and immunities under this contract. They shall not bear liability to the Attendee beyond that of the Organizers, whether in contract or tort.

These Terms represent the entire agreement between BCPI and the Attendee, superseding all prior agreements. Should any provision be invalid under the law or deemed so by a competent court, it will be severed, with the remaining provisions still enforceable.

Cancellations, Changes, and Refund Requests by Attendee

Cancellations can be made any time before the event, subject to the conditions outlined below.

  • Cancellations requested within seven days of purchase and before July 8, 2024, will be fully refunded.
  • Cancellations requested after seven days of purchase or after July 8, 2024 are subject to the following schedule:

No refunds will be issued for no-shows, lost or partially used Passes/tickets, or cancellations requested after July 8, 2024. Refunds will be issued to the original payment method within 60 days of purchase. Beyond 60 days, refunds will be made via PayPal or mailed check (US residents only).

Changes or downgrades that involve a refund will incur a processing fee ($20.00 for Passes, $5.00 for other purchases).

Attendees who initiate a card dispute (chargeback) will be responsible for all cancellation fees and charges as per the Cancellation schedule, in addition to any fees imposed by the card issuer and merchant processor. A chargeback will immediately result in the cancellation of the event Pass, registration, and any add-on purchases, and will also lead to the suspension of the Attendee’s linked BiggerCity account(s). A permanent ban from future events and services provided by BCPI and its affiliates will be also imposed until all unsettled fees are paid.

It is strongly recommended that Attendees book refundable travel, transportation, and lodging and consider purchasing travel insurance from a preferred travel agent. Attendees agree that any travel and lodging arrangements made independently with hotels, airlines, rental car agencies, and other providers for attending the Event are subject to the cancellation policies of those providers. Attendees are responsible for managing these arrangements directly with the respective providers.

Cancellation, Changes, or Postponement by Organizers

The Organizers reserve the right to cancel, relocate, or reschedule the Event.

In the event of cancellation due to a Force Majeure Event (defined below), Attendees will receive a credit for the same or a similar future event equivalent to the amount paid. For this policy, "Force Majeure Event" refers to circumstances beyond the Organizers' reasonable control, including but not limited to: government laws, ordinances, regulations, actions, sanctions, embargoes, military actions, terrorism or war, public disturbances, health emergencies (including epidemics and pandemics like COVID-19), natural disasters (fires, floods, droughts, earthquakes, severe weather), disruptions in transportation, failures of third-party contractors/suppliers, venue damage or cancellation, labor disputes, utility failures, shortages of commodities or supplies, accidents, or any other similar events.

If the Event is canceled, relocated, or rescheduled for reasons other than a Force Majeure Event, the Organizers will offer Attendees one of the following: registration for a rescheduled event, a credit equal to the amount paid towards a future event, or a full refund of fees already paid. This will fully resolve all liabilities of the Organizers to the Attendee.

The Attendee acknowledges that, except as explicitly stated in this policy, they relinquish any claims for damages or compensation related to the Event's cancellation, postponement, relocation, or rescheduling. The Organizers may, at their discretion, change the format, venue, program, or any other aspect of the Event at any time for any reason, regardless of whether or not a Force Majeure Event occurs, without incurring liability.

Event Rules and Obligations

1. Acknowledgment: Attendees acknowledge their understanding of the event's nature and willingly assume all associated risks.

2. Age Requirement: All attendees must be at least 21 years old. Attendees must provide valid proof of age and no one under 21 will be admitted to the Event.

3. Compliance with Venue Rules: Attendees must adhere to all venue regulations, including but not limited to alcohol consumption, no-smoking policies, and prohibitions on marijuana products or illegal substances. Violations may result in removal from the Event by the Organizers, venue management, security, or staff. Although Nevada law permits purchasing marijuana, public smoking of marijuana is illegal and strictly prohibited in many venues, including hotels and casinos.

4. Identification: Attendees must present valid government-issued identification at registration and throughout the Event. Failure to present proper identification will result in denial of participation, with no refunds issued. Non-U.S. Attendees should ensure they meet visa requirements before purchasing a Pass and making travel arrangements.

5. Event Lodging: Attendees booking lodging directly through the Organizers, or via Event-provided links (room block discount) must ensure all individuals in their hotel reservations are registered for the Event. Non-compliance may lead to cancellation of the Attendee's Event registration and Pass without a refund.

6. Marketing Restrictions: Attendees are prohibited from marketing or advertising products, services, or events without prior approval from the Organizers. This includes distribution of handouts, business cards, flyers, promotional materials, or wearing promotional clothing. Event sponsors and vendors have exclusive promotional rights during the Event.

7. BiggerCity Account Requirement: Attendees must have an active, good-standing BiggerCity account which will be linked to their Event Pass during online registration. Attendee agrees that by linking their BiggerCity account to the Event Pass, such account cannot be disabled or cancelled prior to the Event as it will be required to attend and participate in the Event activities. BiggerCity perks, such as Premium time and virtual coins included in Event Pass, will be applied to the linked BiggerCity account on or after July 15, 2024.

8. Event Activities: Tours, excursions, seminars, sessions, or activities are subject to change and may require a minimum attendance. If cancelled due to insufficient attendance, the Organizers may reschedule or offer refunds for those activities which were individually ticketed, sold separately, and not included with a Pass.

9. Lost Passes or Tickets: Replacement of lost Passes or tickets may be available onsite for a fee, at the Organizers' discretion.

10. First-Come, First-Served: All Event activities are available on a first-come, first-served basis.

11. Access and Conduct: The Organizers reserve the right to refuse entry or eject anyone who fails to comply with these terms, poses a security risk, nuisance, or annoyance. Attendees must follow instructions from the Organizers, their staff, volunteers, or venue operators.

Reimbursement for Fines, Expenses, Debts, and Damages

Attendees are responsible for reimbursing the Organizers for any fines or penalties levied by governmental agencies or officials, hotels, venues, vendors, or service providers due to the Attendee's non-compliance with regulations or requirements.

In addition, Attendees must reimburse the Organizers for all costs associated with deviations (including revenue losses) and damages to the Event, its facilities, equipment, operations, or any property of the Organizers. Such liabilities may arise, wholly or partially, from any misconduct or negligent actions or omissions by the Attendee. The Attendee is also required to defend, indemnify, and hold harmless the Organizers, the Event, and their staff, volunteers, and agents from any liabilities related to property damage, personal injury, or death caused, directly or indirectly, by the Attendee or individuals accompanying them.

The Attendee acknowledges and accepts financial responsibilities outlined in this contract, agreeing that any incurred expenses or damages sustained by the Organizers, as specified in the contract, will be charged to the Attendee. Furthermore, in the event of denied attendance or removal from any event, activity, tour, or excursion due to provisions within this contract, the Attendee agrees to the following: the Organizers bear no liability for refunds, compensation, or damages; any alternative accommodation or transportation costs become the sole responsibility of the Attendee; and the Attendee indemnifies the Organizers, allowing them to charge the Attendee for all expenses related to their removal from the Event.

Limits of Organizers’ Liability

By registering for the Event, you acknowledge that the Organizers are not responsible for the intentional or negligent acts of individuals who are not employed by the Organizers. Furthermore, the Organizers are not liable for the actions of its employees, staff, or volunteers that occur outside their job duties or beyond the scope of their employment.

The Organizers are not liable for any emotional distress, mental suffering, or psychological harm experienced by the Attendee under any circumstances.

The Attendee understands that the Organizers reserve the right of admission and have the authority to revoke or cancel admission at any time and for any reason. In the event that an Attendee's registration or Pass is revoked prior to the start of the Event, a full refund will be issued. The Attendee agrees not to seek compensation from the Organizers, including its employees, agents, staff, or volunteers, for any expenses incurred due to cancellation.

Communications, Marketing & Promotions

By registering, Attendees establish a business relationship with the Organizers and authorize the Organizers and their affiliates to communicate with them via email. This includes transactional communications related to the Event, as well as marketing communications. Attendees consent to these communications but may opt out of marketing communications by requesting exclusion from the Organizers.

Attendees, by participating in the Event, grant permission for the unrestricted use of their images in photographs, videos, or other media for promotional and marketing purposes. This applies to both online and offline materials and does not require prior approval. Attendees release the Organizers from any claims and waive the right to review or approve the final content.

If you prefer not to be photographed or recorded, please inform the Organizers during the Event. The Organizers may be able to provide a specially colored lanyard to indicate to photographers, videographers, and other Attendees your preference not to be photographed or recorded. While efforts will be made to accommodate this request, due to the nature of the Event, complete avoidance from appearing in captured materials cannot be guaranteed. By attending, you implicitly consent to the potential use of your image for marketing and promotional purposes as described.

Attendees are expressly prohibited from using any audio recordings, videos, or photographs taken at the Event, including images of other Attendees, staff, volunteers, or third parties, as well as visuals of the Event's layout, equipment, or any aspect thereof, for commercial purposes or public broadcast in any media format without prior written consent from the Organizers. Attendance at the Event signifies an irrevocable agreement to this clause. Compliance is mandatory for attendance and may be enforced legally, including seeking injunctive relief if necessary.

Health and Safety Notice

There is an inherent risk of exposure to communicable diseases in any public gathering. This includes, but is not limited to, diseases such as COVID-19, which are highly contagious and can lead to severe illness and death. By attending the Event, you assume all risks related to exposure to communicable diseases, encompassing any bacteria, virus, or other pathogens capable of causing illness, whether exposure occurs before, during, or after the Event, and regardless of the means of contraction. You hereby waive all claims and potential claims against the Organizers, the Event, its venues, and any affiliated companies, staff, or volunteers.

Dispute Resolution and Governing Law Policy

This agreement and any disputes related to this Event shall be governed and interpreted according to the laws of Cumberland County, Maine, disregarding conflict of law principles. Legal actions or proceedings arising from this agreement are to be exclusively filed in the courts of Cumberland County, Maine.

Any disputes, controversies, or claims arising from or related to this agreement, including its formation, interpretation, breach, or termination, shall be resolved through arbitration. The arbitration, conducted under the American Arbitration Association (AAA) Commercial Arbitration Rules, will take place in Cumberland County, Maine. The arbitrator's decision will be final and binding on both parties.

Should any part of these terms and conditions be found invalid, illegal, or unenforceable, the rest of the provisions will remain valid and enforceable, unaffected by the invalidity.

These terms and conditions represent the entire agreement between the Organizer and the Attendees, replacing any prior written or oral agreements, communications, or understandings about the Event.

The Organizer reserves the right to modify, amend, or update these terms and conditions at any time before the Event without prior notification. Attendees are advised to review these terms periodically for any changes.

By attending the Event, Attendees acknowledge, understand, and agree to comply with these terms and conditions.
